New DOS Guidance on Adjudicating Nonimmigrant Visa Applicants in Third Countries
The U.S. Department of State issued an announcement that, effective immediately, nonimmigrant visa applicants should schedule their visa interview appointments at the U.S. Embassy or Consulate in their country of nationality or residence.
The instructions do not appear to prohibit an applicant from applying in a country other than their country of residence as a Third Country National (TCN). The Department of State website says “applicants who schedule nonimmigrant interviews at a U.S. embassy or consulate outside of their country of nationality or residence might find that it will be more difficult to qualify for the visa.”
Citizens of countries where the U.S. government is not conducting routine nonimmigrant visa operations (such as Iran, Russia, Ukraine, and Venezuela) must apply at a designated embassy or consulate, unless their residence is elsewhere. The guidance provides a specific list of eligible
The announcement says “applicants must be able to demonstrate residence in the country where they are applying, if the place of application is based on their residency.” However, it does not indicate the proof an applicant can show to establish their residence in the country in which the nonimmigrant visa application is being filed.
